Rental agreements for residential properties can contain a lot of unknown risks for landlords and tenants alike. Agreements can be verbal, written or a combination of both and all of them can be legally binding. It is not uncommon for either the landlord or the tenant to dispute the specifics of the contract involved. When it comes to something as important as your accommodation or your property investment it is important that you know your legal rights and what to do in the case of a dispute.

The landlord's responsibilities

• Any repairs to the structure and exterior of the property

• Repairs to sanitary installations including sinks, basins, hot water installations

• Repair and upkeep of any heating systems.

• The safety of gas and electrical supplies, including the ensuring that these are safety-checked by a professional annually.

• Fire safety of the property, including the fire safety of the furniture and fittings

• Ensuring the property is ‘fit for habitation’

• Repair and upkeep of any common areas of multi-occupancy dwellings.

As a tenant you are responsible for:

• The payment of the amount of rent agreed

• Taking care of the property

• Paying the bills deemed payable by yourself; ie electricity, gas, council tax etc.
